Administration and Probate
Everyone knows how important it is to plan for the future, however, we do not all take the steps necessary to ensure that our final needs are met. Though similar, the processes for winding-up a loved one's affairs where an estate plan is in place is different from one where a plan has not been implemented. Where a loved one passed away with a Last Will and Testament, the Will is offered to the Surrogate's Court in the county where the loved one resided for the Court to deem the Will valid and issue Letters Testamentary to the Executor/Executrix; this process is known as probate. Where a loved one passed away without a Will, the Surrogate's Court must be petitioned to appoint a qualified individual as the Administrator of the estate; this process is known as administration. Who qualifies to be an administrator is determined by New York State statute, and it is advantageous to retain an experienced estate attorney to navigate this potentially difficult process.
